Terms of Service

Actuity is not yet an incorporated company. It is run by its founders, Aman Jha (@WhyParabola) and Priyanshu Tiwari (@priyanshudotsol), who are based in New Delhi, India(“Actuity”, “we”, “us”). These Terms are an agreement between you and Aman Jha and Priyanshu Tiwari. You can reach us at actuitytech@gmail.com.

Actuity provides free public scans and customer-approved agent tests. Free, Starter, and Growth have the website, fresh-scan, agent-test, schedule, monitoring, and delivery allowances shown on the pricing page and in workspace billing. A scan checks whether your public pages have what AI agents need. An agent test runs structured and visual profiles against an approved, bounded, public, read-only customer job and produces an evidence-graded Product/QA report. A purchased billing period keeps its snapshotted allowance unless these Terms or law require otherwise.

A public scan may retrieve a publicly accessible URL without logging in or bypassing access controls. For an agent test, repeated testing, or a schedule, you must own the product or have authority from its owner to test it. You must make authorization attestations truthfully and complete verification required for the requested operation. Verification is evidence for our access policy; it does not create legal authority.

You may not overwhelm infrastructure; evade plan, rate, action, or network limits; bypass authentication, paywalls, robots controls, or authorization boundaries; probe non-public network addresses; introduce malicious inputs; resell reports without permission; or facilitate unlawful activity. You may not use the Service to purchase, publish, delete, message, create accounts, or cause other external side effects unless a product flow expressly supports and authorizes that exact action.

You are responsible for safeguarding your accountThe identity and workspace used to access saved reports and paid features. credentials and for all activity under your account. Notify us promptly of unauthorized use. Allowances apply to the workspace and may not be pooled across accounts to evade limits. Workspace owners are responsible for members they authorize.

You define or approve the persona, business need, desired result, public scope, safe inputs, assertions, and stop boundary for each job. Do not include credentials, payment data, secrets, sensitive personal data, or material you lack permission to process. You grant us the limited rights needed to fetch approved public content and process those inputs to provide, secure, support, and improve the Service.

Reports distinguish observations, hypotheses, uncertainty, and technical evidence. Raw screenshots and traces follow the deadline shown in the run and may be deleted early. The outcome report and minimal audit records can remain after raw evidence deletion.

A paid workspace subscriptionA monthly Starter or Growth plan covering one workspace and its included allowances. is processed by Dodo Payments on a recurring monthly basis until cancelled. Checkout shows price and applicable taxes. Dodo hosts payment details; signed provider state determines paid activation, and returning from checkout does not grant access.

There are no overages beyond the included allowance. New metered work stops when a balance is unavailable. Provider or Actuity failures before useful target execution release the reservation; a grounded product-caused inability to complete is a delivered agent test and consumes the credit. Unless the portal says otherwise, cancellation takes effect at the end of the paid period. Reports remain readable during payment recovery, cancellation, and downgrade. Schedules repeat the sealed public job at the cadence and timezone you approve. A quick check between full tests is only a change signal; a customer-facing regression requires confirmation by a full agent test. Starter and Growth deliver confirmed changes in-product and by email. Issue-tracker and chat integrations such as Linear, Jira, and Slack are coming soon and are not included in current plans. You can pause schedules at any time.

We retain rights in the Service, software, methods, and branding. You retain rights in your site content and inputs. Subject to these Terms, you may use, share, and adapt reports and generated fix or issue content for your organization. Feedback may improve the Service without identifying your confidential report content.

To the extent permitted by law, the Service is provided “as is” and “as available”. Results describe the approved job, tested releases, profiles, attempts, and observation period. They do not prove behavior for every model, agent, customer, locale, future release, or network condition. Business impact marked as a hypothesis is not an observed loss or guarantee of conversion improvement.

We may reject or pause a target, run, schedule, integration, or account to protect customers, third parties, providers, or the Service; enforce these Terms; address payment state; or comply with law. Where practical, we explain the reason and recovery path. You may stop using the Service at any time. Subscription cancellation and data deletion are separate actions.

To the maximum extent permitted by law, Actuity is not liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, lost data, or third-party system behavior. Our aggregate liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. Limits that cannot lawfully apply do not apply.

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes arising from these Terms or the Service are subject to the exclusive jurisdiction of the courts at New Delhi, India, except where mandatory consumer-protection law gives you the right to bring a claim elsewhere.

We may update these Terms and will post material changes with a new effective date. If a change materially affects an active paid period, we provide notice as required by law. Continued use after the effective date constitutes acceptance.
